Agreement to These Terms

These terms are a legal agreement between you and The Resume Agent LLC ("we," "us," or "our"), a company registered in Vermont, United States. By using ResumeAgent at https://www.theresumeagent.com, you agree to these terms. If you do not agree, please do not use the service.

We may update these terms from time to time. When we do, we will update the date at the top of this page. Continued use of the service after changes means you accept the updated terms. Contact us at support@theresumeagent.com with any questions.

1. What ResumeAgent Does

ResumeAgent is an AI-powered resume builder. You provide your career history, skills, education, certifications, and other professional details. When you paste a job description, our AI generates a tailored resume, cover letter, or LinkedIn content based on your information. You can edit, customize, and download the output as a PDF.

2. Your Account

You must be at least 18 years old to use ResumeAgent. When you create an account, you agree to:

  • Provide accurate information
  • Keep your password secure
  • Not share your account with others
  • Notify us if you suspect unauthorized access to your account

3. Your Data

You own the content you provide to ResumeAgent — your employment history, skills, education, writing samples, and any other information you enter. We do not claim ownership of your data.

You grant us permission to use your data solely to provide the service — generating resumes, cover letters, coaching feedback, and related features. We do not use your data for any other purpose, and we do not sell it to third parties.

You can delete all of your data at any time from the profile page. Deletion is permanent and removes your knowledge base, generated resumes, cover letters, and account information.

4. AI-Generated Content

Resumes, cover letters, LinkedIn content, and coaching feedback are generated by AI based on the information you provide. You should:

  • Review all generated content for accuracy before using it
  • Not rely on AI-generated content as a substitute for professional career advice
  • Ensure that any claims made in your resume (metrics, titles, dates) are truthful

We do our best to generate accurate, high-quality content, but AI can make mistakes. You are responsible for the final content you submit to employers.

5. Payments and Subscriptions

We accept Visa, Mastercard, American Express, and Discover.

Plans and billing

ResumeAgent offers a free tier and paid monthly subscription plans. Paid plans renew automatically each month. You can view current pricing on our pricing page.

Free trial

New users receive a 5-day free trial with access to all features. After the trial, your account returns to the free tier (1 resume generation per month) unless you subscribe to a paid plan.

Cancellation

You can cancel your subscription at any time from the billing section of your profile page. Your plan remains active until the end of your current billing period. All purchases are non-refundable.

Price changes

We may change subscription pricing from time to time. We will notify you in advance of any price changes.

6. Acceptable Use

You agree not to:

  • Use the service to create fraudulent or misleading resumes
  • Scrape, copy, or extract data from the service through automated means
  • Attempt to bypass usage limits, security measures, or access controls
  • Reverse engineer, decompile, or copy the service's software
  • Use the service to harass, spam, or harm others
  • Share your account credentials with others
  • Resell or redistribute the service without our permission

7. Intellectual Property

The ResumeAgent platform — including its design, code, templates, and branding — belongs to us. You may not copy, reproduce, or redistribute any part of the platform without our written permission.

The resumes and documents you generate using the service are yours. You can use them however you like.

8. Privacy

Your privacy matters to us. Please read our Privacy Notice to understand how we collect, use, and protect your information. By using the service, you agree to our Privacy Notice.

9. Account Termination

You can delete your account at any time from the profile page. This permanently removes all of your data.

We may suspend or terminate your account if you violate these terms or use the service in a way that harms us or other users. If we terminate your account, we will notify you by email when possible.

10. Service Availability

We aim to keep ResumeAgent available at all times, but we cannot guarantee uninterrupted service. We may need to perform maintenance, deploy updates, or respond to issues that temporarily affect availability. We are not liable for any inconvenience caused by downtime.

11. Disclaimer

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT AND WE WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND MATERIALS, (2) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICES, (3) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN, (4) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES, (5) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE SERVICES BY ANY THIRD PARTY, AND/OR (6) ANY ERRORS OR OMISSIONS IN ANY CONTENT AND MATERIALS OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES.

12. Limitations of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE LESSER OF THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING OR $100.00 USD. CERTAIN US STATE LAWS AND INTERNATIONAL LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

13. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) use of the Services; (2) breach of these Terms; (3) a breach of your representations and warranties set forth in these Terms; (4) your violation of the rights of a third party, including but not limited to intellectual property rights; or (5) any harmful act toward any other user of the Services. We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.

14. Dispute Resolution

Informal negotiations

If you have a dispute with us, we ask that you contact us first at support@theresumeagent.com so we can try to resolve it informally. We agree to attempt informal resolution for at least thirty (30) days before pursuing formal proceedings.

Binding arbitration

If we cannot resolve a dispute informally, it will be settled by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association ("AAA"). YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. Arbitration will take place in Chittenden County, Vermont. Any Dispute must be commenced within one (1) year after the cause of action arose.

No class actions

Disputes must be resolved individually. You agree not to participate in class-action lawsuits or class-wide arbitration against us.

15. Governing Law

These terms are governed by the laws of the State of Vermont, without regard to conflict of law principles.

16. Changes to These Terms

We may update these terms from time to time. When we make changes, we will update the date at the top of this page. If we make significant changes, we will notify you by email or through a notice on the site. Your continued use of the service after changes are posted means you accept the updated terms.
